Please read these Terms and Conditions carefully before using the whnacademy.com website (the “Service”). By accessing or using the Women’s Health Nutrition Academy website, you agree to these Terms. If you do not agree, please discontinue use. Lily Nichols, LLC and Boston Functional Nutrition, LLC (collectively referred to as the “Companies”) manage and operate the Women’s Health Nutrition Academy Website.

1. Use of the Website

You agree to use the website responsibly and for lawful purposes only. Any action that disrupts others’ ability to use the website or violates third-party rights is prohibited.

2. Content and Intellectual Property

All materials on this website, including text, images, designs, slides, handouts, videos, and other media, are owned by the Companies unless otherwise specified. The slides produced by guest speakers are the copyright of those respective speakers. These materials are protected by copyright and other intellectual property laws. You may download the content for personal, noncommercial use ONLY, and must not reproduce, distribute, or modify the content without explicit permission.

Copying, reproducing, capturing, or scraping Women’s Health Nutrition Academy content for any purpose without prior consent is prohibited.

3. User Accounts

To access some features (including webinar recordings), you may need to create an account. You are responsible for the security of your account information and all activities under your account. If you suspect unauthorized use, please notify us immediately. Users agree not to share access to their account with third parties. Sharing your account or login credentials may result in suspension or termination of access to the Service.

4. Limitation of Liability

Under no circumstances, including negligence, will Women’s Health Nutrition Academy, its representatives, or contributors be liable for any damages arising from the use or inability to use the site or its content. This includes compensatory, incidental, or consequential damages. Your sole remedy is to stop using the site.

In no event will the Companies’ total liability exceed the amount you paid, if any, for access to the content. Some jurisdictions may not allow certain limitations on liability, so these terms may not apply in all situations.

5. Terms of Purchase

All sales are final. Due to the nature of digital content, no refunds will be provided once the purchase is complete. By purchasing, you acknowledge that you are purchasing a non-refundable, non-transferable license to access the content. If you purchase a ticket to a live webinar, but cannot attend live, no refunds will be issued. All who purchase a ticket to live webinars are automatically granted access to the recording of the webinar.

6. Non-Waiver

Failure to enforce any provision of these Terms does not waive the right to enforce that provision in the future. Only a written agreement signed by an authorized representative of Women’s Health Nutrition Academy can modify these Terms.

The website may include links to third-party sites, which are provided for convenience. We are not responsible for the content, policies, or practices of these external sites, and linking to them does not imply endorsement.

8. Termination of Access

We reserve the right to suspend or terminate your access to the site at any time, without notice, if we believe you have violated these Terms or if we determine such action is necessary for security or legal reasons.

9. Governing Law

These Terms are governed by the laws of the State of Alaska, U.S., without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Alaska.
